February 29, 2012 Is Do or Die for New York City Process Servers

Most process servers in New York City must renew their licenses on February 29, 2012. With this deadline comes the realization that the New York City Department of Consumers Affairs effectively implements its new sets of rules:

1-Every NYC process server must pass a written test regarding process serving laws and other related laws.

2-Every process server or process serving agency must have some sort of surety insurance which may cost $350 for individual process servers and $875 for process service agencies in New York, per year.

3-All process servers must have a GPS device which must electronically report to a third party agency or data base the process server’s activities (attempts) and service of process effected. The “third party” agencies are charging up to $75.00 per month for allowing individual process servers to use their reporting software.

Naturally consumers -litigants and law firms- will have to pay up increased process serving fees if they want to use licensed process servers in New York City. Those fees are estimated to range from $75 to $125 for service of process on one defendant in New York City. Otherwise they will have to rely on themselves to effect service of process or on non-registered process servers who might do process serving for $40 per assignment.

As for myself I will call the New York City Marshals Office to see if they can send me some of their process servers to work for me. I heard that the NYC Marshals are charging about $12.00 for service of process per address, not per defendant. They allegedly use licensed process servers. Eh-Um!
